Plastics company ordered to pay over RM90,000 in tax balance, penalties

MELAKA - The Sessions Court here today ordered a plastics company to pay a total of RM97,965.13 for the outstanding sales tax and penalties that the company had not paid to the Director-General of the Royal Malaysian Customs Department (JKDM) between October 2023 and March 2024.

Judge Raja Noor Adilla Raja Mahyaldin also ordered Super Plastic Enterprise Sdn Bhd and its three directors, namely Wong Piang Kim, 77, Wong Kau Pen, 48, and Lim Bee Hua, 70, to pay a fine of RM18,000 for the three amended charges levied against them.

The court set a fine of RM1,500 for each charge or one month's imprisonment for failure to pay the fine.

According to the three amended charges, the company and the three suspects (OKS) involved jointly on Jan 3, March 1 and May 1 2024 were found to have failed to pay the amount of sales tax due and payable for the taxable period Oct 1 to Nov 30 2023 totalling RM30,797.97 and a penalty of RM14,319.20.

It also involves the taxable period Dec 1, 2023 to Jan 31, 2024 totalling RM28,180.18 and a penalty of RM15,272.08 as well as the taxable period Feb 1 to March 31, 2024 involving a penalty of RM9,395.70.

They were found to have failed to pay the sales tax at JKDM, Wisma Kastam Ayer Keroh here on the relevant dates.

The company and OKS, who were not represented, were charged under Section 26(9) of the Sales Tax Act 2018 which provides for a fine not exceeding RM50,000 or imprisonment not exceeding three years or both.

Kau Pen, who represented the company and OKS, in his appeal requested that the court impose a lower fine since the company had been closed.

JKDM prosecuting officer Mohammad Azhar Habib Anuar requested that the company and OKS be fined RM5,000 each for each charge and requested that the court order the company to repay the sales tax that had failed to be paid along with a penalty. - BERNAMA
