SHAH ALAM - The position of Malaysian Border Control and Protection Agency (AKPS) director-general Datuk Seri Mohd Shuhaily Mohd Zain is being reviewed in consultation with the Attorney-General’s Chambers (AGC) before any decision is submitted to the Yang di-Pertuan Agong, said Inspector-General of Police Tan Sri Mohd Khalid Ismail.
He said the matter had also been brought to the Police Force Commission after Mohd Shuhaily was charged in court with injuring two police personnel.
"His assignment at AKPS is for a two-year term, similar to a contract that requires the consent of the Yang di-Pertuan Agong,” he told reporters after attending the 2026 National Conference on Bureaucratic Red Tape Reform here today, which was also attended by Chief Secretary to the Government Tan Sri Shamsul Azri Abu Bakar.
Mohd Khalid said any proposal concerning a change to Mohd Shuhaily’s term of assignment or action against him must take into account the AGC’s legal advice and obtain the consent of the Yang di-Pertuan Agong.
He said the Royal Malaysia Police would be responsible for Mohd Shuhaily as he is a police officer seconded to serve at AKPS.
As of now, Mohd Shuhaily remains in service at AKPS.
Meanwhile, the Home Ministry (KDN) said the service matters of Mohd Shuhaily are still being finalised.
"KDN will ensure that the matter is handled in an orderly manner in accordance with the applicable rules and procedures,” KDN said in a statement today.
The ministry said it took note of and appreciated public views regarding the service matters of Mohd Shuhaily.
The ministry also stressed that ensuring continuity of operations and the smooth execution of AKPS’ duties were among its priorities in managing the service matters of its officers.
According to KDN, AKPS, which has entered its second year since its establishment, plays an important role in strengthening the management of the country’s border control and protection.
In this regard, the ministry will continue to prioritise border security, the smooth flow of operations, protection of national revenue, as well as integrity and discipline.
"KDN’s priority is to ensure that AKPS remains capable of carrying out its role optimally to safeguard the country’s security and sovereignty,” the statement said.
On Oct 21, Mohd Shuhaily pleaded not guilty at the Sepang Magistrate’s Court to two charges of voluntarily causing hurt to police personnel Faiz Saman and Ekmal Sofwan Dirman at Kuala Lumpur International Airport on Sept 28.
The court set Nov 25 for mention of the case and the submission of documents. - BERNAMA
