Mother charged for sexually abusing sons, creating child porn videos

KLANG - A mother of five pleaded not guilty in the Sessions Court here today to three charges of sexual abuse towards her two sons and making a pornographic video last year.

The unemployed woman, aged 33, pleaded not guilty after the charges were read before Judge Syafeera Mohd Said.

The accused, wearing a dark yellow blouse, faced three charges that involved a person with a fiduciary relationship. As the biological mother, she allegedly sexually abused her two sons, aged 14 and 12 years old at the time of the incident.

The alleged acts took place at a flat unit in Alam Perdana, Puncak Alam, at 8 pm in November 2022.

The charges were filed based on Section 14 (a) and 14 (b) of the Sexual Offences against Children Act 2017 which were read along with Section 16 (1) of the same act.

If convicted, the accused could face a prison sentence of up to 20 years and may also be subjected to whipping as a form of punishment.

The fourth charge was on her creating child pornography in a video form at a hotel in Taman Sri Pristana, Sungai Buloh at 2am on Feb 17, 2022 and Feb 18, 2022.

The charges were made under Section 5 of the same act, which carries a maximum prison sentence of 30 years if convicted. Additionally, if found guilty, the accused could be subjected to whipping of not less than six times as a form of punishment.

During the proceedings, Deputy Public Prosecutors Nurul 'Izzati Mohamad and Nur 'Ayuni Jamri suggested that no bail be granted to the accused, stating the accused posed a risk of disturbing the victims since they were family members.

However, the accused pleaded for bail, stating that she needed it to support her five children.

After hearing the pleas from both parties, Judge Syafeera decided not to grant bail to the accused. The case has been scheduled for remention on June 26.

After the proceedings, the woman could not hold back her tears upon seeing her parents in the public gallery.

Another accused, Haddad Mohd Radhi, aged 22, pleaded not guilty in the same court to charges of physically sexually abusing his 14-year-old daughter.

The alleged offence, which took place at the same hotel and on a similar date, was charged under Section 14 (a) of the same act. During the proceedings, Deputy Public Prosecutor Nurul 'Izzati did not suggest bail for the accused as the charges were considered part of a serious case.

"The accused was a friend of the woman, it could give him access to the victims that are now in the care of the social welfare department," she said.

However, the accused man was represented by lawyer Mohd Azali Ibrahim, who pleaded for bail to be granted on behalf of his client. The lawyer argued that the accused was supporting his wife and child, and requested the court to consider granting bail.

After hearing the pleas from both parties, Judge Syafeera allowed the accused to be placed on bail of RM15,000 with a surety.

Additionally, the accused was required to fulfill an additional condition of reporting at a police station once a month. Furthermore, the accused was ordered not to disturb the victims, their families or the prosecution witnesses.

The court scheduled June 14 for the remention of the case.

Another man was arrested on suspicion of being involved in filming the sexual abuse scene that included both children.

The 25-year-old man, who was working independently, had a history of past records related to rape and extortion.

He was handed over to the Sungai Buloh district police headquarters (IPD) to assist with investigations related to the sexual abuse case involving the woman's 15-year-old daughter.
