A security guard pleaded guilty at the Johor Bahru Sessions Court to 13 charges of committing sexual offences against his six-year-old daughter in January and February.

JOHOR BAHRU – A security guard pleaded guilty at the Sessions Court here on Monday to 13 charges of committing sexual offences against his six-year-old daughter in January and February.

The 43-year-old accused entered his plea after all the charges were read out before Judge Mohd Zamir Suhaimee.

According to the charge sheets, he faces four counts of committing physical sexual assault against his daughter, together with his girlfriend, who is also the child’s biological mother, between Jan 22 and Feb 17.

He is also charged with four counts of non-physical sexual assault for allegedly engaging in sexual acts in front of the victim between Jan 23 and Feb 16.

The accused also faces two charges of committing carnal intercourse against the order of nature against the child on Feb 16 and 17.

He is also charged with two counts of producing child sexual abuse material involving the victim without her consent on Jan 22 and Feb 23, as well as one count of rape on Feb 17.

The charges for physical sexual assault were brought under Section 14(b) of the Sexual Offences Against Children Act 2017, while the non-physical sexual assault charges were framed under Section 15(c) of the same Act.

The offence of carnal intercourse against the order of nature is punishable under Section 377C of the Penal Code, which carries a prison sentence of between five and 30 years, as well as whipping, if convicted.

The charge on production of child sexual abuse material in video form was framed under Section 5 of the Sexual Offences Against Children Act 2017, while the rape charge was framed under Section 376(3) of the Penal Code.

All the offences were allegedly committed at a squatter house near Kampung Kempas Baru here between 11.35pm on Jan 22 and the morning of Feb 17.

The prosecution was conducted by deputy public prosecutors Nur Farah Wahida Shahudin and S. Manushri, who did not offer bail as the offences are non-bailable.

The court fixed March 4 for mention for the submissions of facts and sentencing. No bail was granted to the unrepresented accused.

In a separate Sessions Court, the accused’s 46-year-old girlfriend, who works as a food stall assistant, was charged as a person having custody of the child with exposing the victim to harm, resulting in physical injury.

The offence was allegedly committed at the same location in February. She was charged under Section 31(1)(a) of the Child Act 2001, which carries a fine of up to RM50,000, imprisonment of up to 20 years, or both, upon conviction.

She pleaded not guilty before Judge Datuk Ahmad Kamal Arifin Ismail.

The prosecution was conducted by deputy public prosecutor Mohd Afdhallan Syafiq Azmy, while the accused was also unrepresented.

The court allowed her bail at RM8,000 with one surety, subject to additional conditions that she surrender her international passport to the court and report to the Pontian District Police Headquarters once a month.

The case was fixed for mention on April 2 for the appointment of counsel and the submission of documents.
