Man jailed 33 years for rape, physical sexual assault of two granddaughters

MUAR - The Sessions Court here today sentenced a 67-year-old man to 33 years’ imprisonment and 14 strokes of the cane for raping and physically assaulting his granddaughters last year.

Judge Mohd Khairi Haron handed down the sentence after the man pleaded to five counts of raping and physically assaulting the two girls.

Mohd Khairi also ordered the man to undergo counselling while in prison and to be placed under police supervision for three years after completing his time, in line with Section 26 and Section 27 of the Sexual Offences Against Children Act 2017.

For the two counts of sexual assault, the man was charged with committing the act on his step-granddaughter at a house in Parit Raja Tengah, Batu Pahat in January and December last year.

The charge was framed under Section 14 (a) of the Sexual Offences Against Children Act 2017 read together with Section 16 of the same law.

The elderly man was also charged with two counts of raping the child at the same time and location, with the charges framed under Section 376 (2) (d) of the Penal Code, which provides a prison sentence of up to 30 years and whipping, if convicted.

In addition, the man was also charged with committing physical sexual assault on the victim's nine-year-old sister at the same location last year, an offence under Section 14 (a) read together with Section 16 of the same law.

In mitigation, the man, unrepresented, requested a reduced sentence considering his advanced age as well as his remorse and repentance.

However, Deputy Public Prosecutor Nur Ameerah Allaudeen requested a severe sentence because the offence committed was serious and involved family relationships. - BERNAMA
