Man gets 39 years and caning for raping daughter, causing pregnancy

PUTRAJAYA - The Sessions Court today sentenced a man to 39 years' imprisonment and 10 strokes of the cane after he pleaded guilty to three charges of raping his biological daughter, which resulted in her becoming pregnant.

Judge Datin M. Kunasundary ordered the accused, aged 46, to serve the prison sentences consecutively for each charge, beginning from the date of his arrest on June 19.

For the first charge, the court imposed 15 years' imprisonment and five strokes of the cane, while for the second and third charges, the accused was sentenced to 12 years each, with three and two strokes respectively.

In her judgment, Kunasundary stressed that the heavy penalty was meant to act as a deterrent, a warning to both the accused and the public that such offences would not be taken lightly.

"In imposing this sentence, the court has taken into account the fact that the accused pleaded guilty on the very first day he was brought before the court," she said.

"However, the accused's offences are utterly heinous, and the suffering endured by a child since the age of 12 cannot be overlooked. The accused's conduct is akin to a snake devouring its own young," the judge said.

In addition to the prison sentence and caning, the court also ordered the accused to undergo rehabilitation counselling throughout his imprisonment, as well as police supervision for two years upon completion of his sentence.

According to the charges, the man had raped the victim around early 2024, late 2024, and this month, at a house here.

The charges were brought under Section 376B(1) of the Penal Code, which provides for imprisonment of between 10 and 30 years, as well as caning, upon conviction.

The prosecution was conducted by deputy public prosecutor V. Suloshani, while the accused was unrepresented.

Based on the facts of the case, the abhorrent act came to light after the accused took the victim to a hospital for a medical examination, where a doctor confirmed that the teenage girl was more than six weeks pregnant.

Earlier, Kuala Lumpur police chief Datuk Fadil Marsus said a report had been received regarding the case from a medical officer at the hospital on June 18.

Investigations revealed that the victim, now aged 17 years and 10 months, is believed to have been forced into sexual relations by her biological father since she was 12 years old. - BERNAMA
