The Court of Appeal has fixed August 19 to deliver its decision in an appeal brought by an activist over the dismissal of her lawsuit that had challenged the validity of parts of a provision in the Communications and Multimedia Act 1998 that criminalises offensive online comments.

A 37-year-old woman, who was converted to Islam when she was a child, lost her final appeal at the Federal Court, to overturn a Court of Appeal decision to reinstate her as a Muslim.

The Federal Court today ruled that the Parliament and the state legislature cannot make laws beyond the list in the Ninth Schedule of the Federal Constitution.
