KUALA LUMPUR – Datuk Seri Mohd Shuhaily Mohd Zain remains the Director-General of the Malaysian Border Control and Protection Agency (AKPS), as he has yet to receive any official letter or directive on his reported transfer back to the Royal Malaysia Police (PDRM).
One of his lawyers, Muhammad Rafique Rashid Ali, said his client remained authorised to carry out his duties as director-general until the transfer process was finalised.
He said Mohd Shuhaily had continued performing his duties as usual, including chairing agency meetings.
“He has yet to receive any directive or official letter. Therefore, he continues to carry out his duties as he still holds the authority of the director-general.
“So far, my client has not been found guilty and is entitled to perform his duties and responsibilities as usual,” he told reporters at the Court Complex here on Thursday.
Rafique also urged Home Minister Datuk Seri Saifuddin Nasution Ismail to clarify his statement that Mohd Shuhaily had been transferred back to the PDRM.
He said the minister's statement appeared to contradict the situation on the ground, raising questions about his client's current status.
He added that clarification was necessary to prevent confusion and speculation surrounding Mohd Shuhaily's position.
“The public is now questioning the situation, as the minister has made one statement, but what is happening on the ground suggests otherwise.
“Therefore, the minister needs to clarify this matter as it has given rise to various speculations,” he said.
On Oct 29, Saifuddin said Mohd Shuhaily had been transferred back to the PDRM.
Mohd Shuhaily, 54, previously served as Bukit Aman Criminal Investigation Department (CID) director for three years from 2023 before being appointed AKPS director-general for a two-year term from July 1, 2025 to June 30, 2027.
Questions over his position as the agency's top official arose after he was absent from the AKPS second anniversary celebration at a hotel in Sepang recently.
Mohd Shuhaily returned to work on Nov 2 after taking a week's leave.
On Oct 21, he pleaded not guilty at the Sepang Magistrates' Court to two charges of voluntarily causing hurt to two police officers, Mohamad Faiz Saman, 40, and Muhammad Ekmal Sofwan Dirman, 25.
The alleged offences took place between 1.27pm and 1.35pm on Sept 28 near Counter J, Level 5, Terminal 1 of KLIA.
