Road damage: Victims can file lawsuits, claim compensation

As taxpayers, users naturally expect the roads they travel to be free from any damage.

SHAH ALAM - Users involved in road damage incidents have the right to file lawsuits against maintenance companies or state governments for compensation purposes.

Universiti Putra Malaysia Road Safety Research Centre Chief Professor Madya Dr Law Teik Hua said that both parties should be fully responsible for the related accidents.

"As taxpayers, users naturally expect the roads they travel to be free from any damage.

"If they are involved in road damage incidents due to the negligence of the government or maintenance companies that fail to maintain properly, then the parties involved should be fully responsible for the losses suffered by users," he told Sinar on Monday.

Malaysian Institute of Road Safety Research (Miros) Associate Fellow Tengku Ahmad Marwan Tengku Mahmud said complaints could be made to the Royal Malaysia Police (PDRM) and road-related parties, especially road owners, if they experience vehicle damage or bodily injury.

He said that claims that can be made against road owners include general or special compensation in court with the assistance of legal services.
