No further action against Zahid after AGC reviews latest evidence

THE Attorney-General’s Chambers (AGC) decision not to proceed with further action (NFA) against Umno president Datuk Seri Ahmad Zahid Hamidi over 47 charges linked to Yayasan Akalbudi funds on Thursday marks a significant development in the country’s legal and political landscape.

The decision was made after the AGC reviewed the full findings of investigations and new evidence submitted following the Kuala Lumpur High Court’s ruling on Sept 4, 2023, which granted Zahid a discharge not amounting to an acquittal (DNAA) for the charges.

According to the AGC, further detailed investigations were carried out by the Malaysian Anti-Corruption Commission (MACC), covering issues related to the source of the funds, how they were obtained and how they were used.

The review also took into account six representations submitted by Zahid after he was called to enter his defence in court.

From a legal point of view, the NFA decision differs from the earlier DNAA.

A DNAA allows the prosecution to reopen the case if new evidence emerges, while an NFA is a final position by the prosecution based on current investigations and available evidence.

Politically, the AGC’s decision is expected to have an impact on Zahid’s image and standing as a key leader within Umno and the government.

Although the decision was based on legal considerations, it has drawn public attention as the high-profile case has long been in the public spotlight.

Overall, the development highlighted the role of enforcement and prosecution institutions in making decisions based on evidence and legal principles.
